Buyer Beware- A Guide To Buying And Selling Ancient Indian Artifacts

Written by Matt Dorso – Knoxville TN

“Caveat emptor” is a Latin phrase that translates to “let the buyer beware.” It serves as a warning to potential buyers that they purchase goods or services at their own risk. This principle emphasizes the buyer’s responsibility to thoroughly research and ask detailed questions about the product before completing the purchase. Once the transaction is finalized, any issues that arise are typically not the seller’s responsibility.

The following steps will increase the likelihood of a successful transaction.  These steps can be applied to any purchase: online, auctions, and retail stores.  Let the buyer beware! When buying antiquities from online auction sites, it is essential to exercise common sense and refer to the principle of caveat emptor (“let the buyer beware”). Here are some practical steps to ensure a cautious and informed purchase:

  1. 1.Research the Seller:
    • Check the seller’s ratings and reviews.
    • Verify the seller’s reputation and history of dealing in antiquities.
    • Look for any complaints or red flags from previous buyers.
  2. 2.Authenticate the Item:
  1. Request detailed photographs and descriptions of the item.
  2. Ask for provenance documentation to verify the item’s history and authenticity.
  3. Consult with experts or appraisers who specialize in antiquities.
  4. 3.Understand the Terms:
  1. Read the auction site’s policies on returns, refunds, and guarantees.
  2. Know the terms and conditions of the sale, including any buyer’s premiums or additional fees.
  3. 4.Verify Legality:
  1. Ensure that the antiquities are legally obtained and can be legally sold.
  2. Be aware of international laws and regulations regarding the import and export of cultural artifacts.
  3. 5.Conduct Due Diligence:
  1. Research the market value of similar items to ensure fair pricing.
  2. Look for any signs of restoration or repair that might affect the item’s value.
  3. 6.Ask Questions:
  1. Communicate directly with the seller to clarify any doubts or concerns.
  2. Inquire about the item’s condition, origin, and any known issues.
  3. 7.Use Secure Payment Methods:
  1. Use secure and traceable payment methods to protect against fraud.
  2. Avoid transactions that require direct bank transfers or other non-secure payment options.

By applying these steps, buyers can better protect themselves and make informed decisions when purchasing antiquities online. Always remember the principle of caveat emptor to stay vigilant and cautious throughout the buying process.
